TERMS OF PURCHASE

1. AGREEMENT TO TERMS

These Terms of Purchase (the "Terms") govern all purchases made from Giame Digital Design LLC ("Company," "we," "us," or "our") through www.creatorflowcollective.com or any affiliated platforms.

BY COMPLETING A PURCHASE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS.

If you do not agree to these Terms, do not purchase or access our products, services, programs, memberships, or digital goods.

2. PRODUCTS COVERED BY THESE TERMS

These Terms apply to, but are not limited to:

AI Bot Vault (15+ custom AI assistants and all future updates)
UGC Training Programs (all tiers and modules)
Digital Product Creation Systems (courses, templates, and resources)
Multiple Income Stream Education (Amazon Influencer, TikTok Shop, affiliate marketing training)
Brand Twin AI Setup Services
Private Community Memberships (annual, monthly, or lifetime access)
One-time digital products (ebooks, guides, templates, checklists, scripts)
Coaching programs (group or individual)
Workshops and masterclasses (live or recorded)
Bundles and package deals
Affiliate commission opportunities
Any other digital or educational product or service offered by Giame Digital Design LLC

3. NATURE OF DIGITAL PRODUCTS

You acknowledge and agree that:

All products sold by Giame Digital Design LLC (including, without limitation, AI Bot Vault, courses, trainings, templates, ebooks, and guides) are digital products and/or educational services delivered electronically.
Upon completion of your purchase, you receive immediate access to the product(s) or service(s) purchased via download, email delivery, or access to an online portal/platform.
Because these items are delivered digitally and accessible immediately, they are considered “used” the moment they are purchased (i.e., once access is granted or delivery is made).
Digital products cannot be “returned” in the traditional sense, as they are instantly accessible and/or downloadable upon purchase.
The delivery of digital content (including granting access credentials) constitutes full performance of our obligation under the sales contract.

4. NO REFUNDS (ALL SALES FINAL)

ALL SALES ARE FINAL. No refunds will be provided under any circumstances.

Because our products are digital and/or provide immediate access, you acknowledge that the product is considered “used” upon purchase and/or once access is granted. Accordingly, refunds, returns, exchanges, transfers, chargeback “reversals,” credits, or substitutions will NOT be issued for any reason, including but not limited to:

Change of mind or buyer's remorse
Failure to use the product or service
Lack of time to complete the program or course
Personal circumstances or financial hardship
Technical difficulties on the customer's end (including but not limited to internet connectivity, device compatibility, or user error)
Dissatisfaction with content, teaching style, or results
Duplicate purchases or accidental purchases
Failure to read product descriptions, terms, or policies before purchase
Misunderstanding of what the product includes or delivers
Non-attendance at live sessions or failure to access materials within a specified timeframe
Comparison to other products, competitors, or expectations based on third-party information
Claims that the product "did not work" or "did not produce results"
Requests made after any period of time has elapsed from the date of purchase

5. YOUR RESPONSIBILITY BEFORE PURCHASE

It is YOUR RESPONSIBILITY to:

Thoroughly review all product descriptions, sales pages, promotional materials, and terms before completing your purchase.
Understand what is included in the product or service you are purchasing.
Ask questions via our customer support channels BEFORE purchasing if you have any doubts or concerns.
Ensure you have the technical capability (internet connection, compatible device, email access) to access digital products.
Verify that your payment information is correct before submitting payment.

Ignorance of product details, features, or this No Refund Policy does not entitle you to a refund.

6. CHARGEBACKS AND PAYMENT DISPUTES (FRAUD & BREACH OF TERMS)

6.1 Chargeback and Dispute Prohibition

By purchasing from Giame Digital Design LLC, you agree to NOT initiate a chargeback, payment dispute, or reversal with your credit card company, PayPal, bank, or any other payment processor for any purchase that is valid and properly delivered.

Any attempt to dispute a valid charge for a digital product or access-based offering after delivery is considered a material breach of these Terms.

6.2 Consequences of Chargebacks

If you initiate a chargeback or payment dispute:

Your access to ALL Giame Digital Design LLC products, services, memberships, and communities will be immediately and permanently revoked without exception.
You will be permanently banned from future purchases and participation in any Giame Digital Design LLC offerings.
Your personal information (name, email, payment details) will be added to our internal "Do Not Sell" list.
We reserve the right to pursue legal action to recover the cost of the product, chargeback fees (typically $15-$100 per chargeback), administrative costs, and legal fees.
We reserve the right to report fraudulent chargebacks to appropriate authorities and industry fraud prevention networks.

6.3 Evidence of Product Delivery and Use

Giame Digital Design LLC maintains comprehensive records including:

Purchase confirmation emails and receipts
IP address logs
Login timestamps and access history
Download logs and/or content view timestamps
Login activity and access logs to digital products and platforms
Community participation records
Email correspondence and support ticket history
Proof of product delivery via electronic means

These records may be provided to payment processors and financial institutions in the event of a chargeback dispute to demonstrate access, delivery, and/or use, including to contest fraudulent or invalid claims.

6.4 Support and Proper Dispute Resolution

If you experience technical issues accessing your purchase, you agree to contact us at support@creatorflowcollective.com for assistance before initiating any payment dispute. We will make reasonable efforts to help resolve access or technical issues. Filing a dispute instead of contacting support does not void these Terms or our No Refund policy.

7. EXCEPTIONS

There are NO EXCEPTIONS to this No Refund Policy, except in the following rare circumstances, determined solely at the discretion of Giame Digital Design LLC:

Technical Failure on Our End: If we are unable to provide access to a purchased product due to a technical failure on our servers or systems, and we cannot resolve the issue within a reasonable timeframe (30 days), we may issue a refund.
Duplicate Billing Error: If you are charged multiple times for the same purchase due to a processing error on our end, we will refund the duplicate charge(s).
Legal Requirement: If a refund is required by applicable law in your jurisdiction.

Any exception granted under this section does not set a precedent for future requests and remains entirely at our discretion.

8. LIFETIME ACCESS CLARIFICATION

Products advertised as offering "lifetime access" refer to access for the lifetime of the product or platform, not the lifetime of the customer. We reserve the right to:

Discontinue or modify products at any time
Update, remove, or replace content
Change platform providers or access methods
Sunset products that are no longer viable or supported

In such cases, no refunds will be issued. We will make reasonable efforts to provide advance notice and alternative solutions when feasible.

9. COMMUNITY AND MEMBERSHIP ACCESS

For recurring memberships or subscription-based access:

You may cancel your membership at any time to prevent future billing.
Cancellation does NOT entitle you to a refund for any prior payments, including the current billing period.
Upon cancellation, you will retain access until the end of your current paid period, after which access will be terminated.
No partial refunds will be issued for unused portions of a membership period.

10. AFFILIATE COMMISSIONS

If you are participating in our affiliate program:

Chargebacks or refunds on products you referred will result in the reversal of any commissions earned on those sales.
Fraudulent activity or abuse of the affiliate program will result in immediate termination of your affiliate account and forfeiture of any unpaid commissions.

11. MODIFICATIONS TO PRODUCTS

We reserve the right to:

Update, modify, or improve any product or service at any time without notice
Correct errors in content, pricing, or product descriptions
Discontinue products or features

No refunds will be issued due to product modifications, updates, or discontinuations.

12. EARNINGS DISCLAIMER

You acknowledge and agree that:

Results from educational products and business training programs vary based on individual effort, circumstances, market conditions, and numerous other factors.
Giame Digital Design LLC makes NO GUARANTEES regarding income, earnings, results, or outcomes from using our products or services.
Any earnings or income examples are illustrative only and are not a promise or guarantee of actual results.
Your success depends on your own effort, dedication, execution, and factors beyond our control.

13. FRAUDULENT PURCHASES

We reserve the right to:

Refuse or cancel any order suspected of being fraudulent or unauthorized
Revoke access to products obtained through fraudulent means
Report fraudulent activity to appropriate authorities
Pursue legal action against individuals engaging in fraud

15. INTELLECTUAL PROPERTY AND LICENSE (PERSONAL USE ONLY)

All content and materials provided by Giame Digital Design LLC, including without limitation AI Bot Vault prompts, prompt libraries, workflows, training videos, written lessons, guides, templates, checklists, scripts, slide decks, workbooks, downloads, and any related materials (collectively, the "Content") are owned by Giame Digital Design LLC and are protected by intellectual property laws.

Subject to your compliance with these Terms, Giame Digital Design LLC grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Content for your personal, non-commercial use only (unless a specific product’s written terms expressly permit commercial use of outputs).

You may NOT, and you agree not to:

Copy, reproduce, publish, distribute, sell, resell, sublicense, rent, lease, lend, assign, gift, or otherwise transfer the Content (in whole or in part)
Share logins or grant access to any other person
Upload, post, or transmit the Content (or any portion) to any website, shared drive, repository, group chat, or file-sharing service
Create competing products using the Content, or represent the Content as your own

Any unauthorized use constitutes a material breach of these Terms and may result in immediate termination of access without refund, in addition to any other remedies available to us.

16. COMMUNITY CONDUCT

If your purchase includes access to any private community, group, forum, chat, or membership area (including third-party platforms), you acknowledge that access is a privilege, not a right.

We reserve the right, in our sole discretion, to remove you and/or revoke community access (temporarily or permanently) for misconduct, including but not limited to harassment, hate speech, spamming, doxxing, sharing confidential information, violating platform rules, or violating these Terms. No refunds will be provided if access is revoked for misconduct.

17. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

Giame Digital Design LLC is not responsible or liable for any technical issues outside of our control, including but not limited to internet failures, device incompatibility, third-party platform outages, or user error.
Giame Digital Design LLC is not responsible or liable for your business decisions, actions, outcomes, profits, losses, or any results (or lack of results) that occur from implementing any information, strategies, or Content provided.
In no event shall Giame Digital Design LLC be liable for any indirect, incidental, special, consequential, or punitive damages.
Our total liability for any claim relating to a purchase shall not exceed the amount you paid for the product at issue.

18. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

19. SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

20. MODIFICATION OF TERMS

Giame Digital Design LLC reserves the right to modify, update, or change these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our products or services following any changes constitutes acceptance of the modified Terms.

The "Last Updated" date at the top of this document indicates when the Terms were last revised.

21. ENTIRE AGREEMENT

These Terms, together with our Terms of Service and Privacy Policy (if posted), constitute the entire agreement between you and Giame Digital Design LLC regarding purchases, access, and refunds.

By making a purchase from Giame Digital Design LLC, you confirm that you have read, understood, and agree to be bound by these Terms of Purchase in their entirety.
